Terms and Conditions for WHEP Mobility Services

2.1 Permitted Uses:

• Using the route planner for personal or business travel planning.
• Accessing vignette and toll information for compliance purposes.
• Utilizing real-time traffic data for informed decision-making.
• Integrating our APIs for legitimate business operations as per separate contractual agreements.

2.2 Prohibited Activities:

• Illegal activities, including but not limited to fraud, harassment, or distribution of harmful software.
• Any action that disrupts or compromises the integrity or performance of our services or servers.
• Unauthorized access to user accounts or data.
• Reselling, sublicensing, or distributing our services without explicit written permission.
• Reverse engineering, decompiling, or attempting to extract the source code of our software.

3.1 Account Security:

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Promptly notify WHEP Mobility of any unauthorized use or security breach.

3.2 Intellectual Property:

All content, software, design, text, graphics, data, and other materials on WHEP Mobility's platforms are the exclusive property of WHEP Mobility Panel AG or its licensors and are protected by Swiss and international intellectual property laws. Your use of our services grants you a limited, non-exclusive, non-transferable license to use the services for their intended purpose, subject to these terms. Unauthorized reproduction, modification, distribution, or public display is strictly prohibited.

These Terms & Conditions and any disputes arising out of or in connection with them or our services shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of laws principles. The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms & Conditions or the use of WHEP Mobility services shall be Lucerne, Switzerland.

WHEP Mobility Panel AG provides its services on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall WHEP Mobility, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the services; (iii) any content obtained from the services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

While we strive for accuracy, WHEP Mobility does not warrant that the information provided regarding compliance, tolls, or traffic is error-free or exhaustive. Users are solely responsible for ensuring their compliance with all applicable laws and regulations before embarking on any journey.

WHEP Mobility reserves the right to modify, suspend, or discontinue any aspect of its services (or any part thereof) with or without notice at any time. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the services.

We may revise these Terms & Conditions from time to time. The most current version will always be available on our website. By continuing to access or use our services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the services.

You may terminate your account with WHEP Mobility at any time. WHEP Mobility may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms & Conditions.

Upon termination, your right to use the services will immediately cease. If you wish to terminate your account, you may simply discontinue using the services or delete your account through our platform where available. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Regarding data retention, WHEP Mobility will handle your personal data in accordance with our Privacy Policy. Upon account termination, we will delete or anonymize your data as required by applicable data protection laws, unless retention is necessary for legal purposes.
